Terms & Conditions – "Rising Rock Bands of India"
• The “Rising Rock Bands of India” (hereinafter referred to as Program) is brought to you in association with Only Much Louder Entertainment Private Limited (“OML”)is open to all persons who register on the web site of ibibo Web Pvt. Ltd. (“Company”) or to existing Company registered user, being a resident of India and above 18 years of age (“Participant”).
• The duration of the Program shall be from July 27th, 2009 to January 27th, 2010. (“term”).
• To be eligible for the Program, each Participant shall create his/her individual as well as their band profile and upload their songs on ibibo.com (“website”) The profiles created and the songs uploaded shall be in compliance with and in no manner be obscene or defamatory or in contravention to the terms and conditions enlisted on the website. Further, the songs uploaded by the Participant shall be their original compositions and shall in no manner cause infringement of Intellectual Property Right(s) of any third party.
• Creation of profiles and uploading songs shall be a compulsory pre requisite for valid registration. Any Participant not creating such profiles or uploading their songs shall be considered as an invalid entry.
• Participants hereby grant rights to the Company to use the songs, pictures etc. uploaded on the website by the Participants for their present and future marketing promotions.
• At the end of each month, one Participating band shall be selected on the basis of songs uploaded by them on the website through a specially constituted panel comprising of well know music industry celebrities (“Winner(s)”). These Winners shall get to record an Album with OML. (“Album”).
• The Winner for each month shall be announced within 7 days from end of the respective month.
• Winners shall be notified via email and or/ contact numbers mentioned on their profiles. It is mandatory for the Participants to upload at least 2 contact numbers on their profiles.
• Winners may be required to travel to 3 different cities for their performances.
• All costs of travel, boarding and lodging of the Winners for any activity, including the performances undertaken as part of this Program, will have to be borne by the Winners themselves. Neither the Company nor OML shall be responsible for the same in any manner whatsoever. The Winners agree to ensure that they abide by the itinery set by the Company and OML for this Program failing which the Winners shall be liable to indemnify the Company and/or OML for the damages, losses etc. suffered by them due to the same. This will be without prejudice to any other legal remedy that the Company or OML may initiate. The Company shall not allow any change/re scheduling to the said itinery.
• Winners must use their own guitars, leads, distortion pads etc. for the performances.
• No remuneration for damage to the winner(s) equipment will be provided by the Company or OML.
• Violation of any of the terms mentioned or rules framed may lead to permanent disqualification of the Winner from the Program.
• Decision of panel shall be deemed to be final. The panel shall judge the Participants based on set parameters like quality, performance etc
• The Company shall reserve the right to use all data, material etc. received as part of this Program as it may deem fit for its future promotions.
• The Company also reserves the right to amend the rules of the Program or extend the period or cancel or discontinue the Program or any part thereof without giving any reasons or prior notice.
• The Company reserves the right to change the prize due to circumstances beyond its control or to offer an alternative of similar value.
• Winners must fully comply with rules and regulations framed by OML. Winners will be required to execute additional documents with OML, which they agree to do without any demur or protest.
• A registered user can win only once during the duration of the Program.
• No correspondence shall be entertained with regard to the Program.
• The laws of India govern the Program. All disputes shall be settled within the jurisdiction of Gurgaon only.
• The Program will continue to be governed by the terms and condition of the website.
